對外承包工程步入法制(zhi)化軌(gui)道

—國務院法(fa)制(zhi)辦負責人就《對外承(cheng)包工程(cheng)管理條例》答記者問

       國務(wu)院(yuan)總(zong)理(li)溫家寶日(ri)前(qian)簽署國務(wu)院(yuan)令(ling)公布了《對外承包工(gong)程管理(li)條例》(以下簡稱條例)。條例將于2008年9月(yue)1日(ri)起施行。國務(wu)院(yuan)法制辦(ban)負責人(ren)近日(ri)就(jiu)條例的(de)有關(guan)問(wen)題(ti)回答(da)了新(xin)聞社記者的(de)提(ti)問(wen)。

      問(wen):為(wei)什么要專門制(zhi)定關于對外承包工程的行(xing)政法(fa)規?

      答(da):對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng),是(shi)(shi)(shi)實(shi)施“走出去”戰(zhan)略的(de)(de)(de)(de)主要形式之一。近年(nian)來,我(wo)(wo)國(guo)(guo)對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)發(fa)展很(hen)快,這對(dui)(dui)(dui)(dui)于擴(kuo)大對(dui)(dui)(dui)(dui)外(wai)(wai)經(jing)濟(ji)技術合(he)作(zuo),充分利用國(guo)(guo)際國(guo)(guo)內兩個市場(chang),提(ti)高我(wo)(wo)國(guo)(guo)企業的(de)(de)(de)(de)國(guo)(guo)際競爭力(li)(li),加強(qiang)我(wo)(wo)國(guo)(guo)與其他國(guo)(guo)家特別(bie)是(shi)(shi)(shi)周邊(bian)國(guo)(guo)家和(he)發(fa)展中國(guo)(guo)家的(de)(de)(de)(de)政治、經(jing)貿關系,發(fa)揮著越來越重要的(de)(de)(de)(de)作(zuo)用。于此同時(shi),我(wo)(wo)國(guo)(guo)對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)的(de)(de)(de)(de)總(zong)體水平仍然比(bi)較低,在(zai)快速發(fa)展過程(cheng)(cheng)(cheng)中存在(zai)一些(xie)亟待(dai)解(jie)決的(de)(de)(de)(de)問題。主要是(shi)(shi)(shi):一些(xie)對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)的(de)(de)(de)(de)單位(wei)在(zai)資金(jin)、技術、管理能力(li)(li)以及商業信譽等方面的(de)(de)(de)(de)條(tiao)件難(nan)以適應開展對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)的(de)(de)(de)(de)需要,守(shou)法意識(shi)和(he)嚴(yan)格履約的(de)(de)(de)(de)意識(shi)薄弱;對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)的(de)(de)(de)(de)質量(liang)和(he)安全生產管理以及安全保障有待(dai)進一步加強(qiang);侵(qin)害(hai)外(wai)(wai)派人員合(he)法權(quan)益的(de)(de)(de)(de)現象時(shi)有發(fa)生。這些(xie)問題,不(bu)僅(jin)直接影響我(wo)(wo)國(guo)(guo)對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)的(de)(de)(de)(de)健康(kang)發(fa)展,也關系到我(wo)(wo)國(guo)(guo)的(de)(de)(de)(de)國(guo)(guo)際聲譽以及與工(gong)程(cheng)(cheng)(cheng)項目(mu)所在(zai)國(guo)(guo)家的(de)(de)(de)(de)政治、經(jing)貿關系。為了規(gui)范對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng),促(cu)進對(dui)(dui)(dui)(dui)外(wai)(wai)承包(bao)工(gong)程(cheng)(cheng)(cheng)健康(kang)發(fa)展,國(guo)(guo)務院制定了本(ben)條(tiao)例。

 ;     問:條例在對外(wai)承包工(gong)程的(de)促進機制方面做了哪些規(gui)定?

      答:條例從三(san)個方(fang)面(mian)(mian)規定(ding)(ding)了對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的促(cu)進機制(zhi)(zhi):一是,規定(ding)(ding)國(guo)家鼓(gu)勵(li)和(he)支(zhi)持開展對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng),提(ti)(ti)高對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的質量(liang)和(he)水平;國(guo)務(wu)院有(you)關(guan)(guan)部門制(zhi)(zhi)定(ding)(ding)和(he)完善促(cu)進對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的政策(ce)措施,建(jian)立、健(jian)全對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)服(fu)務(wu)體系和(he)風險保障機制(zhi)(zhi)。二是,規定(ding)(ding)國(guo)務(wu)院商(shang)務(wu)主管部門應當(dang)(dang)會同國(guo)務(wu)院有(you)關(guan)(guan)部門建(jian)立對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)信(xin)息(xi)(xi)收集、通報(bao)制(zhi)(zhi)度(du),對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的單(dan)(dan)位無償提(ti)(ti)供(gong)信(xin)息(xi)(xi)服(fu)務(wu);有(you)關(guan)(guan)部門應當(dang)(dang)在(zai)貨物通關(guan)(guan)、人員(yuan)出入境(jing)等(deng)(deng)方(fang)面(mian)(mian),依法為(wei)對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的單(dan)(dan)位提(ti)(ti)供(gong)快捷、便利(li)的服(fu)務(wu)。三(san)是,規定(ding)(ding)了有(you)關(guan)(guan)對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)的協(xie)(xie)會、商(shang)會在(zai)促(cu)進對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)方(fang)面(mian)(mian)的職責,包(bao)(bao)括按照章程(cheng)(cheng)(cheng)為(wei)其(qi)成員(yuan)提(ti)(ti)供(gong)與對外(wai)(wai)(wai)(wai)(wai)承(cheng)包(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)有(you)關(guan)(guan)的信(xin)息(xi)(xi)、培(pei)訓等(deng)(deng)方(fang)面(mian)(mian)的服(fu)務(wu),依法制(zhi)(zhi)定(ding)(ding)行業規范,發(fa)揮協(xie)(xie)調和(he)自律作用(yong),維(wei)護(hu)公(gong)平競爭和(he)成員(yuan)利(li)益(yi)。

      問:條例為什么要規定對外承包工程資格(ge)制度?

      答:當(dang)(dang)前對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)中存在的(de)(de)主要問(wen)題,在很大程(cheng)度上與對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)單位(wei)自身(shen)的(de)(de)條件和(he)素(su)質(zhi)有關(guan)。為了(le)減少盲目性,防止“一哄(hong)而起”,根據對外(wai)(wai)貿易(yi)法(fa)(fa)關(guan)于從事對外(wai)(wai)工(gong)(gong)程(cheng)承(cheng)(cheng)(cheng)包的(de)(de)單位(wei)應(ying)(ying)當(dang)(dang)具備相應(ying)(ying)的(de)(de)資(zi)(zi)(zi)質(zhi)或資(zi)(zi)(zi)格的(de)(de)規定,條例確立了(le)對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)資(zi)(zi)(zi)格制度,規定對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)的(de)(de)單位(wei)應(ying)(ying)依照本(ben)條例的(de)(de)規定取(qu)(qu)得對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)資(zi)(zi)(zi)格,并從法(fa)(fa)人資(zi)(zi)(zi)格、資(zi)(zi)(zi)金、管理(li)人員和(he)專(zhuan)業(ye)技術人員、安全防范能(neng)力(li)、工(gong)(gong)程(cheng)質(zhi)量和(he)安全生產保障(zhang)能(neng)力(li)以及商(shang)業(ye)信譽等方面,對取(qu)(qu)得對外(wai)(wai)承(cheng)(cheng)(cheng)包工(gong)(gong)程(cheng)資(zi)(zi)(zi)格的(de)(de)單位(wei)應(ying)(ying)當(dang)(dang)具備的(de)(de)條件做了(le)規定,特別是明確規定工(gong)(gong)程(cheng)建設類單位(wei)應(ying)(ying)當(dang)(dang)依法(fa)(fa)取(qu)(qu)得特級(ji)(ji)或者(zhe)一級(ji)(ji)(甲級(ji)(ji))資(zi)(zi)(zi)質(zhi)證書,體現了(le)適度從嚴的(de)(de)原(yuan)則。

      同時(shi),為了加強對外(wai)承(cheng)包工程資(zi)格的(de)動態(tai)管(guan)理,條(tiao)(tiao)例明確規定(ding),國務(wu)(wu)院(yuan)商務(wu)(wu)主(zhu)管(guan)部門和省、自治區、直(zhi)轄市(shi)人民(min)政府商務(wu)(wu)主(zhu)管(guan)部門在(zai)監督檢查中,發現對外(wai)承(cheng)包工程的(de)單位不再(zai)具備本條(tiao)(tiao)例規定(ding)條(tiao)(tiao)件的(de),應(ying)當(dang)責(ze)令其限期整改;逾(yu)期仍達不到條(tiao)(tiao)件的(de),吊(diao)銷其對外(wai)承(cheng)包工程資(zi)格證(zheng)書。

      問:在加強對外承包工程(cheng)的(de)工程(cheng)質量和安全生產方(fang)面,條例作了哪些規定?

      答:開展對(dui)外(wai)承包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng),必(bi)須確保工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan),樹立(li)我國對(dui)外(wai)承包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)(de)良好形象(xiang)。為(wei)(wei)此,條例(li)作了三(san)個方面的(de)(de)(de)規(gui)定(ding)(ding):一(yi)是,明(ming)確規(gui)定(ding)(ding)對(dui)外(wai)承包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)(de)單(dan)(dan)(dan)位應當(dang)加(jia)強對(dui)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)的(de)(de)(de)管(guan)理(li),建立(li)、健全(quan)(quan)(quan)(quan)并(bing)(bing)嚴格執行工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)管(guan)理(li)的(de)(de)(de)規(gui)章制度。二是,針對(dui)工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目分(fen)(fen)包(bao)(bao)(bao)(bao)中質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)問題(ti)較為(wei)(wei)突出的(de)(de)(de)實際(ji)情況(kuang),規(gui)定(ding)(ding)對(dui)外(wai)承包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)(de)單(dan)(dan)(dan)位應當(dang)與分(fen)(fen)包(bao)(bao)(bao)(bao)單(dan)(dan)(dan)位訂立(li)專門的(de)(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)管(guan)理(li)協議,或(huo)在分(fen)(fen)包(bao)(bao)(bao)(bao)合(he)同中約定(ding)(ding)各自的(de)(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)管(guan)理(li)責(ze)任,并(bing)(bing)對(dui)分(fen)(fen)包(bao)(bao)(bao)(bao)單(dan)(dan)(dan)位的(de)(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)(liang)(liang)和安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)統一(yi)協調、管(guan)理(li);禁(jin)止將工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目分(fen)(fen)包(bao)(bao)(bao)(bao)給不具備國家規(gui)定(ding)(ding)的(de)(de)(de)相應資質(zhi)的(de)(de)(de)境內(nei)單(dan)(dan)(dan)位,或(huo)者(zhe)將工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目的(de)(de)(de)建筑(zhu)施工(gong)(gong)(gong)部分(fen)(fen)分(fen)(fen)包(bao)(bao)(bao)(bao)給未依法取(qu)得安(an)(an)(an)全(quan)(quan)(quan)(quan)生(sheng)(sheng)產(chan)許可證的(de)(de)(de)境內(nei)建筑(zhu)施工(gong)(gong)(gong)企業。三(san)是,明(ming)確禁(jin)止分(fen)(fen)包(bao)(bao)(bao)(bao)單(dan)(dan)(dan)位將工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目轉(zhuan)包(bao)(bao)(bao)(bao)或(huo)者(zhe)再(zai)分(fen)(fen)包(bao)(bao)(bao)(bao),規(gui)定(ding)(ding)對(dui)外(wai)承包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)(de)單(dan)(dan)(dan)位應當(dang)在分(fen)(fen)包(bao)(bao)(bao)(bao)合(he)同中明(ming)確約定(ding)(ding)分(fen)(fen)包(bao)(bao)(bao)(bao)單(dan)(dan)(dan)位不得將工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目轉(zhuan)包(bao)(bao)(bao)(bao)或(huo)者(zhe)再(zai)分(fen)(fen)包(bao)(bao)(bao)(bao),并(bing)(bing)負責(ze)監督。

      問:條例如何保(bao)障各項制度措施的(de)落實?

      答:為了保障各項制度措施切實得到遵守,條例對未取得對外承包工程資格擅自從事對外承包工程、未建立并嚴格執行工程質量和安全生產管理的規章制度、將工程項目分包給不具備國家規定的相應資質的單位或者將工程項目的建筑施工部分分包給未依法取得安全生產許可證的境內建筑施工企業、分包單位將工程項目轉包或者再分包,以及以不正當的低價承攬工程項目、串通投標或者進行商業賄賂等違法行為,都規定了明確、嚴格的法律責任。從法律責任的種類看,除責令改正、沒收違法所得和罰款外,還包括禁止對外承包工程的單位在一定限期內對外承包新的工程項目、吊銷其對外承包工程資格證書;對工程建設類單位,還可以由建設主管部門或者其他主管部門降低其資質等級或者吊銷其資質證書。                     ——摘自《中國建設報》
